Terms and conditions

The terms on which you may use the HamaraNeta app and website: accounts, civic complaints, events and payments, acceptable use, and grievance redressal.

1.Accepting these terms

These terms are an agreement between you and HamaraNeta for the use of the HamaraNeta app, this website and the services offered through them. By creating an account or using the service, you accept these terms and our privacy policy. If you do not agree with them, please do not use the service.

2.Who can use HamaraNeta

You must be at least 18 years old to hold an account. A person under 18 may use the service only through the account of, and with the supervision of, a parent or lawful guardian who accepts these terms on their behalf. You must be capable of entering into a binding contract under Indian law and must not be barred from using the service under any applicable law.

3.Your account

  • Give accurate details when you register, and keep them up to date.
  • Keep your password and the verification codes we send you confidential. Anything done through your account is treated as done by you.
  • Hold one account per person. Accounts may not be sold, shared or transferred.
  • Tell us immediately at support@hamaraneta.in if you believe your account has been used without your permission.

4.Civic complaints

HamaraNeta routes the complaint you file to the ward, department and elected representative responsible for it, and shows you the status reported back. We are a platform that carries your complaint. We are not a government authority, we do not decide complaints, and we cannot promise that any complaint will be resolved or resolved within a particular time.

  • File complaints truthfully, about a real civic issue, with an accurate location and photographs of the issue itself.
  • Do not file false, misleading, duplicate or malicious complaints, and do not use a complaint to target an individual.
  • Complaints and photographs may be visible to the concerned authority and its staff, and may be published in aggregate or anonymised form.
  • We may remove a complaint and suspend an account that breaches these rules.

In an emergency, contact the emergency services directly. HamaraNeta is not an emergency service and must not be used to report situations that need an immediate response.

5.Events, registrations and payments

  • Events are listed by organisers or by our team. The organiser is responsible for the event itself, its schedule, venue, conduct and any promise it makes to attendees.
  • Some events are free and some charge a registration fee. The fee shown at registration is the amount payable, in Indian rupees, unless stated otherwise.
  • Payments are processed by a third-party payment gateway. We receive a record of the transaction, not your card, UPI or bank credentials.
  • Where registration happens on an external website linked from a listing, that website terms govern your registration and payment.
  • A registration is personal to you and may not be resold or transferred unless the organiser allows it.
  • Refunds and cancellations for a paid event follow the organiser policy stated on the event. If an event is cancelled by the organiser, the organiser is responsible for the refund.
  • You can view your registrations at any time under your engagements, and cancel a free registration from there.

6.Content you post

You keep ownership of the text, photographs and other material you submit. By submitting it you grant HamaraNeta a non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, and share that material with the authorities and organisers concerned, for the purpose of operating the service. You confirm that the material is yours to share, that it does not infringe anyone else rights, and that you have the consent of any identifiable person in a photograph you upload.

7.Acceptable use

While using HamaraNeta you must not:

  • Break any law, or post anything unlawful, defamatory, obscene, hateful, or that incites violence or enmity between groups.
  • Impersonate another person, an official or an organisation, or misrepresent your association with one.
  • Upload malware, attempt to gain unauthorised access, probe or test the security of the service, or interfere with its operation.
  • Scrape, harvest or bulk-extract data from the service, or use automated means to access it without our written permission.
  • Copy, modify, reverse engineer or create derivative works from the app or website except as permitted by law.
  • Send spam, advertise, or use the service to collect personal data about other users.

8.Third-party services

The service uses third parties for maps, messaging, storage and payments, and links to app stores, organiser websites and government portals. Their terms and privacy policies apply to what you do on them. We are not responsible for the content or practices of a website or service we do not operate.

9.Availability and changes to the service

We work to keep HamaraNeta available and accurate, but we provide it on an as-is basis. Features may be added, changed, suspended or withdrawn, and access may be interrupted for maintenance or reasons beyond our control. We do not warrant that the service will be uninterrupted or error-free, or that the information shown, including complaint status reported by an authority, is complete or accurate at all times.

10.Our intellectual property

The HamaraNeta name, logo, design, software and content other than user-submitted material belong to HamaraNeta or its licensors, and are protected by intellectual property law. You may not use them without our prior written permission.

11.Liability

To the extent permitted by law, HamaraNeta is not liable for indirect, incidental, special or consequential loss, or for loss of data, profits, goodwill or opportunity, arising out of your use of the service, the conduct of an authority or organiser, or an event you attend. Nothing in these terms limits liability that cannot be limited under Indian law.

12.Suspension and closing your account

You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms, if your use puts other users or the service at risk, or if we are required to do so by law. Where it is reasonable to do so, we will tell you why.

13.Grievance redressal

For a complaint about content, conduct on the platform, or the service itself, contact our Grievance Officer appointed under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

We acknowledge a grievance on receipt and resolve it within the timelines those rules prescribe. Data protection grievances are handled as described in our privacy policy.

14.Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Delhi have exclusive jurisdiction over any dispute arising out of or in connection with them.

15.Changes to these terms

We may update these terms as the service develops. The date at the top of this page shows when they last changed, and we will give notice in the app or by email before a material change takes effect. Continuing to use HamaraNeta after that means you accept the updated terms. Questions can go to support@hamaraneta.in.
